§ 1 Two Separate Processes: Withdrawal vs Complaint

It is important to distinguish between two independent legal processes:

  • Withdrawal from the contract (Return): Returning goods without giving a reason within 14 days — when you simply change your mind.
  • Complaint under warranty: Reporting a product defect — when the goods are damaged or do not match the order. Valid for 2 years.

§ 2 Right of Withdrawal (14 days)

1. Deadline: 14 days from the day you or a third party designated by you took possession of the item.
2. How to notify: Email to info@house-of-seeds.de, by mail, or using the withdrawal form available in the Terms and Conditions.
3. Restrictions (Art. 38 point 5 of the Consumer Rights Act): The right of withdrawal does not apply to products delivered in sealed packaging if the packaging was opened after delivery.
4. Refund: We process refunds within 14 days of receiving the withdrawal statement, using the same payment method.
5. Return shipping costs: The consumer bears the cost of return shipping.

§ 3 Complaints under Warranty (2 years)

1. The seller is liable to the consumer for physical and legal defects of the product under warranty for 2 years (Art. 556 et seq. of the Civil Code).
2. Note: Failure of seeds to germinate is not a product defect, as germination is prohibited in Poland, and seeds are sold as collector’s souvenirs. Complaints apply, for example, to seeds crushed during transport in sealed, original packaging.
3. Please submit complaints by email to info@house-of-seeds.de. Complaints will be processed within 14 days.

§ 4 Product Damaged in Transit

A product damaged during delivery is not a withdrawal but a transport complaint. Contact us immediately — we will replace the product free of charge. Details in the Delivery Policy.
